1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BURST FIREFLAME TECH LIMITED ("Company," "we," "us," or "our") regarding your use of The Basketball Star mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

The Basketball Star is a casual mobile basketball game where players:

• Control a falling basketball by tapping the screen to make it bounce
• Attempt to score baskets through timing and precision
• Use energy to play game sessions (100 energy per game)
• Can purchase energy through in-app purchases

The App is free to download and play, with optional in-app purchases available.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian to use the App and make purchases.

By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Account and Responsibilities

You are responsible for:

• Maintaining the security of your device and account
• All activities that occur under your account
• Ensuring that your use of the App complies with all applicable laws

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to hack, reverse engineer, or modify the App
• Use automated systems or software to extract data from the App
• Interfere with or disrupt the App or servers
• Impersonate any person or entity
• Use the App to transmit any harmful code or malware

5. In-App Purchases and Energy System

5.1 Energy and Pricing

The App uses an energy system for gameplay:

• Each game session requires 100 energy
• Energy can be purchased at the rate of $1 USD = 100 energy
• All prices are in United States Dollars (USD)

5.2 Payment Processing

All in-app purchases are processed through PayPal. By making a purchase, you agree to PayPal's terms and conditions. We do not store your payment information.

5.3 No Purchases on Website

The Basketball Star website (thebasketballstar.com) does not support or process any purchases. All purchases must be made within the mobile App.

5.4 Non-Refundable

All purchases are final and non-refundable except as required by applicable law or as stated in our refund policy. Energy purchased cannot be transferred, exchanged for cash, or refunded.

5.5 Pricing Changes

We reserve the right to modify pricing at any time. Price changes will not affect purchases already made.

6. Refund Policy

Generally, all sales are final. However, we may provide refunds in the following circumstances:

• Technical errors that prevent you from receiving purchased energy
• Unauthorized purchases (subject to verification)
• As required by applicable consumer protection laws

To request a refund, contact us at burstfireflame2025@outlook.com within 14 days of purchase with your transaction details.

7. Intellectual Property Rights

The App and all content, features, and functionality are owned by BURST FIREFLAME TECH LIMITED and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works of the App
• Distribute, sell, or transfer the App to third parties
• Remove any copyright or proprietary notices
• Use the App or its content for commercial purposes

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the App will immediately cease. You will not be entitled to any refund of unused energy or purchases.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the App will be uninterrupted, error-free, or secure
• That defects will be corrected
• The accuracy or reliability of any content

Your use of the App is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURST FIREFLAME TECH LIMITED SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or technical failures
• Any damages arising from your use or inability to use the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless BURST FIREFLAME TECH LIMITED and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiations between the parties
• If negotiations fail, binding arbitration in Hong Kong
• The arbitration shall be conducted in English

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms in the App
• Updating the "Last Updated" date
• Sending you a notification (if applicable)

Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BURST FIREFLAME TECH LIMITED regarding the App and supersede all prior agreements and understandings.
